By utilizing the digital consulting, development, or design services provided by Flint Digital (hereinafter 'The Company'), you signify your irrevocable acceptance of these Terms of Service.
We reserve the right to update or modify these terms at any time without prior notice.
Flint Digital provides the following services:
Upon receipt of full payment, all custom-developed creative assets, source code, and design files produced specifically for the Client under a signed Statement of Work (SOW) shall be owned by the Client. Flint Digital retains ownership of its proprietary methodologies, pre-existing code libraries, and general frameworks used to deliver the services.
A non-refundable commencement deposit of 50% for all fixed-fee projects. Net-15 payment terms on all subsequent invoices unless specified otherwise. Interest of 1.5% per month applied to any outstanding balances exceeding 30 days.
To the maximum extent permitted by law, Flint Digital shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability for any claim arising under these terms shall not exceed the total amount paid by the Client to Flint Digital in the twelve (12) months preceding the claim.
Either party may terminate a service engagement with thirty (30) days' written notice.
